Terms and conditions

The HMHfour name, its logo, and the texts, design and images of the site belong to HMH Sistemas or its licensors. These terms give you no right over them, other than viewing them for your personal use. You may not use the name or the logo without prior written authorization.

The information on the site, including features, plans and prices, is general and informational and may change without notice. Features described as upcoming or in development are not available and are not a promise.

When you subscribe to a plan, the conditions and prices shown in the app at the time of purchase apply. If they differ from the site, the information in the app prevails.

The site links to the HMHfour application and may link to third-party sites. HMH Sistemas does not control those sites and is not responsible for their content or policies.

The site is provided as is, with no guarantee that it will always be available or error-free. HMH Sistemas is not liable for damages resulting from the use of the site, to the extent the law allows.

To use the service you need an account:

• Whoever registers an organization must be over 18 and have the authority to bind that organization to these terms.
• If you subscribe in a personal capacity, you must be over 18 and have the legal capacity to enter into contracts.
• People invited by an organization, or who request access to one, must be at least 16 and have the organization's authorization.
• The information you provide when registering must be truthful and up to date.
• Your credentials are personal. Do not share them: you are responsible for the activity that takes place under your account.
• If you suspect unauthorized access to your account, tell us right away at the support email.

Each organization has administrators who decide who has access, with which roles and what data is uploaded. The organization is responsible for how its users use the service and for their compliance with these terms.

If the plan includes chat auditing, administrators can audit the organization's chat conversations. The organization must inform its users of this.

The service has a free plan and paid plans, with different features and limits. Current plans and prices are shown on the Pricing page and in the app before you subscribe.

When you change plans, the previous plan is cancelled and the new one starts, and your balance is adjusted with a discount that depends on the conditions of the change. The app shows you the final amount before you confirm. See the Cancellation and refunds policy.

Free plans may show Google AdSense ads in the app.

You can activate the trial of a higher plan only once, for the number of days the app indicates. When the trial ends, your account returns to its previous plan.

Payments are made inside the app and processed by Stripe.

By subscribing to a paid plan you expressly agree to be charged on a recurring basis. Before you confirm, the app shows you the billing frequency, the amount and the charge date.

Paid plans renew automatically every month until you cancel them. We will notify you of each renewal at least 5 calendar days in advance, by email and with a notification in the app, so that you can cancel without penalty.

You can cancel your paid plan or your account at any time from the app. Cancellation is immediate and carries no penalty. When you cancel a paid plan you keep its features until the period you already paid for ends.

Refunds, where applicable, are governed by the Cancellation and refunds policy.

After you cancel your account we keep your data for 30 days and then delete it, except what the law requires us to keep. The application does not include a function to export all your data, so download the files and reports you need before cancelling.

By using the service you agree not to:

• Use it for unlawful purposes or upload content that infringes third-party rights or the law.
• Attempt to access accounts, data or systems that are not yours, or breach the security of the service.
• Interfere with the service or overload it, including through abusive automations or API calls.
• Copy, decompile or reverse engineer the software, except as the law allows.
• Resell, sublicense or transfer access to the service without HMH Sistemas' authorization.
• Run security or load tests without our prior written authorization.

We may suspend or limit an account if you breach these terms, if there is a risk to the security of the service or if an authority requires it. Where possible, we will notify you beforehand.

The data an organization uploads to the app, such as projects, tasks, messages, files and data about its employees, remains the organization's. The organization grants HMH Sistemas a limited license to host and process it for the sole purpose of providing the service.

The organization is responsible for the lawfulness of the data it uploads and for having the consent or legal basis required to upload it, including employee data such as salary, bank account, RFC, reviews and documents. In the app, this data is only visible to the roles with permission.

For the personal data an organization uploads to the app, the organization is the controller and HMH Sistemas is the processor. By registering, the organization accepts this section as a data processing agreement. HMH Sistemas undertakes to:

• Process that data only to provide the service and in accordance with the organization's instructions and these terms.
• Not use it for its own purposes or transfer it, except on the organization's instruction or when the law requires it.
• Apply administrative, technical and physical security measures to protect it.
• Keep it confidential and require the same of anyone with access to it.
• Subcontract services only to providers that accept equivalent confidentiality and security obligations.
• Help the organization respond to ARCO rights requests from data subjects.
• Notify the organization of security breaches that affect its data, so that it can act.
• Delete the data when the relationship ends, within the timeframes in the cancellation section.

For its part, the organization must inform data subjects through its own privacy notice and give the lawful instructions that are necessary.

The service includes personal access tokens, an API and an MCP server to connect tools and artificial intelligence agents. Their availability may depend on your plan.

Tokens act with the same permissions as your user. You are responsible for safeguarding them and for everything done with them; if you suspect one has leaked, revoke it.

If you connect a third party's artificial intelligence agent or service, that third party receives the data the agent reads or processes, and its own terms apply. HMH Sistemas is not responsible for those third parties.

The software, the brand and the other elements of the service belong to HMH Sistemas or its licensors. We grant you a limited, non-exclusive, non-transferable and revocable license to use the service while your account is active.

If you give us suggestions or feedback about the service, we may use them without any obligation to you.

The service is provided as available, with no guarantee of uninterrupted or error-free operation. We may perform maintenance and updates that temporarily interrupt it.

HMHfour is a management tool and does not replace legal, labor or tax advice. The organization is responsible for configuring its policies, such as vacation and absence policies, in line with the law that applies to it. To the extent the law allows, we give no warranties other than those expressly set out in these terms.

To the extent the law allows, HMH Sistemas is not liable for indirect damages, loss of profits or data loss due to causes beyond its control.

HMH Sistemas' total liability to you for any claim related to the service is limited to the amount you paid to HMH Sistemas in the 12 months before the event giving rise to it. If you made no payments in that period, there will be no liability for economic damages.

Nothing here limits liability for willful misconduct or anything the law does not allow to be limited.

If you subscribe as an individual for your own use and the law regards you as a consumer, these terms do not limit the rights that the Federal Consumer Protection Law grants you and that you cannot waive, and you may go to the Federal Consumer Protection Agency (PROFECO). If any clause contradicts them, the law prevails.

We may terminate your access if you seriously or repeatedly breach these terms, or if the law requires it. In that case, your data will be handled as explained in the cancellation section.

We may modify these terms and the prices of the plans. We will notify you at least 30 days in advance, by email and in the app. Changes apply when that period ends and, for prices, from the next renewal.

If you do not agree, you can cancel before they take effect. The current version and its update date are always on this page.
